Limited Warranty Information

1.0 HARDWARE: The Pinax Group Ltd. ("The Pinax Group") warrants to the original purchaser ("Customer") that this product will be free from defects in workmanship and materials, under normal use, for one year from the date of original purchase from The Pinax Group or its authorized retailer. If this product does not operate as warranted above during the applicable warranty period, The Pinax Group may, at its option and expense, replace the defective product or part with a comparable product or part, repair the defective product or part, or, if neither replacement nor repair is reasonably available, refund to Customer the purchase price for the defective product or part. Proof of date of original purchase will be required. Replacement products or parts may be new or reconditioned. The Pinax Group will warrant replaced or repaired products or parts 'and hardware upgrades to which Customer is entitled by agreement between Customer and The Pinax Group for a period of ninety (90) days from shipment of such product, part or upgrade, or through the end of the original warranty, whichever is longer. All products or parts that are replaced become the property of The Pinax Group. Accessory products, if any, are not covered under this Limited Warranty. The Pinax Group shall not be responsible for Customer's software, firmware, or other information, contained in, stored on, or integrated with any products returned to The Pinax Group for repair, whether under warranty or not.

1.1 SOFTWARE: The Pinax Group warrants to Customer that the software programs licensed from it will perform in substantial conformance to the program specifications therefor for a period of ninety (90) days from the date of original purchase from The Pinax Group or its authorized retailer. The Pinax Group warrants the media containing software against failure during the warranty period. Proof of date of purchase will be required. No updates are provided. The sole obligation of The Pinax Group with respect to this express warranty shall be (at the discretion of The Pinax Group) to refund the purchase price paid by Customer for any defective software products, or to replace any defective media with software which substantially conforms to applicable Pinax Group published specifications. The Pinax Group makes no warranty or representation that its software products will meet your requirements or will work in combination with any hardware or applications software products provided by third parties, that the operation of the software products will be uninterrupted or error free, or that all defects in the software products will be corrected.

1.2 OBTAINING WARRANTY SERVICE: Customer must contact The Pinax Group's Technical Support facilities within the applicable warranty period to obtain warranty service authorization. Dated proof of original purchase will be required. The Pinax Group is not responsible for Customer products or parts received without warranty service authorization. Repaired or replacement products serviced under warranty will be shipped to Customer at the Pinax Group's expense. The repair and replacement process for products or parts in locations outside of the United States will vary dependent on Customer's location. Products or parts shipped by Customer must be sent prepaid and packaged appropriately for safe shipment; obtaining insurance for packages is advisable. In the United States, if such products or parts are not shipped by Customer to arrive at The Pinax Group within thirty (30) days from the date warranty service authorization is provided, Customer will pay the Pinax Group the price of such product or part at the product?s then current price.

1.3 WARRANTIES EXCLUSIVE: IF THIS PRODUCT DOES NOT OPERATE AS WARRANTED ABOVE, CUSTOMER'S SOLE REMEDY FOR BREACH OF THAT WARRANTY SHALL BE REPLACEMENT OR REPAIR OF THE PRODUCT OR PART OR REFUND OF THE PURCHASE PRICE PAID, AT THE OPTION OF THE PINAX GROUP AND DEPENDENT UPON PRIOR AUTHORIZATION. TO THE FULL EXTENT ALLOWED BY LAW, THE FOREGOING WARRANTIES AND REMEDIES ARE EXCLUSIVE AND ARE IN LIEU OF ALL OTHER WARRANTIES, TERMS, OR CONDITIONS, EXPRESS OR IMPLIED, EITHER IN FACT OR BY OPERATION OF LAW, STATUTORY OR OTHERWISE, INCLUDING WARRANTIES, TERMS, OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND SATISFACTORY QUALITY. THE PINAX GROUP NEITHER ASSUMES NOR AUTHORIZES ANY OTHER PERSON TO ASSUME FOR IT ANY OTHER LIABILITY IN CONNECTION WITH THE SALE, INSTALLATION, MAINTENANCE OR USE OF ITS PRODUCTS.

1.4 The Pinax Group shall not be liable under this warranty if its testing and examination disclose that the alleged defect in the product does not exist or was caused by Customer's or any third person's misuse, neglect, improper installation or testing, unauthorized attempts to repair or modify, or any other cause beyond the range of the intended use, or by accident, fire, lightning, or other hazards or acts of God. This warranty does not cover physical damage to the surface of the product, including cracks or scratches on the LCD. This warranty does not apply when the malfunction results from the use of this product in conjunction with accessories, other products, or ancillary or peripheral equipment and The Pinax Group determines that there is no fault with the product itself. This warranty does not apply to the failure of the product or part due primarily to any communication service Customer may subscribe to or use with the product.

1.5 LIMITATION OF LIABILITY: TO THE FULL EXTENT ALLOWED BY LAW THE PINAX GROUP ALSO EXCLUDES FOR ITSELF AND ITS SUPPLIERS ANY LIABILITY, WHETHER BASED IN CONTRACT OR TORT (INCLUDING NEGLIGENCE), FOR INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES OF ANY KIND, OR FOR LOSS OF REVENUE OR PROFITS, LOSS OF BUSINESS, LOSS OF INFORMATION OR DATA, OR OTHER FINANCIAL LOSS ARISING OUT OF OR IN CONNECTION WITH THE SALE, INSTALLATION, MAINTENANCE, USE, PERFORMANCE, FAILURE, OR INTERRUPTION OF THIS PRODUCT, EVEN IF THE PINAX GROUP OR ITS AUTHORIZED RESELLER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND LIMITS ITS LIABILITY TO REPLACEMENT OR REPAIR OF THE PRODUCT OR PART, OR REFUND OFTHE PURCHASE PRICE PAID, AT THE OPTION OF THE PINAX GROUP. THIS DISCLAIMER OF LIABILITY FOR DAMAGES WILL NOT BE AFFECTED IF ANY REMEDY PROVIDED HEREIN SHALL FAIL OF ITS ESSENTIAL PURPOSE.

1.6 UNITED STATES GOVERNMENT LEGEND: The software provided with the product is commercial in nature and developed solely at private expense. The software is delivered as "Commercial Computer Software" as defined in DFARS 252.227-7014 (June 1995) or as a commercial item as defined in FAR 2.101(a) and as such is provided with only such rights as are provided in the license agreement, which is The Pinax Group's standard commercial license for the Software. Technical data is provided with limited rights only as provided in DFAR 252.227-7015 (Nov. 1995) or FAR 52.227-14 (June 1987), whichever is applicable.

1.7 GOVERNING LAW: This Limited Warranty shall be governed by the laws of the State of California, U.S,A. Some countries, states, or provinces do not allow the exclusion or limitation of implied warranties or the limitation of incidental or consequential damages for certain products supplied to consumers or the limitation of liability for personal injury, so the above limitations and exclusions may be limited in their application to you. When the implied warranties are not allowed to be excluded in their entirety, they will be limited to the duration of the applicable written warranty. This warranty gives you specific legal rights which may vary depending on local law.

1.8 FCC Statement
1.8.1 This device complies with part 15 of the FCC rules. Operation is subject to the following two conditions: (1) This device may not cause harmful interference, and (2) this device must accept any interference received, including interference that may cause undesired operation.

1.8.2 Note: This equipment has been tested and found to comply with the limits for a Class B digital device, pursuant to Part 15 of the FCC rules. These limits are designed to provide reasonable protection against harmful interference in a residential installation. This equipment generates, uses, and can radiate radio frequency energy and, if not installed and used in accordance with the instructions, may cause harmful interference to radio communications. However, there is no guarantee that interference will not occur in a particular installation. If this equipment does cause harm to radio or television reception, which can be determined by turning the equipment off and on, the user is encouraged to try to correct the interference by one or more of the following measures:

  • Reorient or relocate the receiving antenna.
  • Increase the separation between the equipment and receiver.
  • Connect the equipment into an outlet on a circuit different from that
    to which the receiver is connected.
  • Consult the dealer or an experienced radio/TV technician for help.
  • The use of shielded I/0 cables is required when connecting this equipment to any and all optional peripheral or host devices. Failure to do so may violate FCC rules.

1.8.3 Caution: Changes or modifications not covered in this manual must be approved in writing by the manufacturer's Regulatory Engineering Department. Changes or modifications made without written approval may void the user's authority to operate this equipment.

1.9 Canadian RFI Statement
1.9.1 This Class B digital apparatus meets all requirements of the Canadian Interference-Causing Equipment Regulations.
